Scope and Acceptance
These Terms of Use ("Terms") govern your access to and use of Hold my Frame, including the website, application, media browsing tools, search, pitch, project, upload and account features (together, the "Service"). The Service is operated by FADED Filmproduktion e.U., Vienna, Austria ("Hold my Frame", "we", "us").
By creating an account, accessing the Service, or using any part of the platform, you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of a company, agency, studio or other organization, you confirm that you are authorized to accept these Terms on its behalf.
Accounts and Access
The Service is currently invite-only and requires an approved account. You must provide accurate account information, keep it up to date, and protect your login credentials. You are responsible for activity that happens through your account unless it results from our own security failure.
You may not share your account, transfer it to another person, or allow unauthorized users to access the Service. You must notify us immediately if you suspect unauthorized access. Users must be at least 16 years old.
Team and Company Use
If you use the Service for an agency, studio, production company, brand, client or other organization, you confirm that you have authority to use the Service in that context and to submit any project data, briefs, prompts, uploads or other materials you provide.
Unless we expressly agree otherwise in writing, accounts are personal to the named user. Team, company or studio use does not permit credential sharing, pooled accounts, shared logins, automated seats, or access by people who do not have their own authorized account. If an organization manages or pays for access, it remains responsible for ensuring that its users comply with these Terms.
Fair Use and Account Sharing
Plans are priced for normal professional use by the authorized user or users covered by the plan. Fair use means using the Service in a human, project-related workflow and staying within applicable plan, feature, search, upload, download, export, processing and API limits.
You may not share passwords, maintain shared inbox or pooled logins, rotate access among multiple people through one account, resell access, automate use, or use one account to provide a service bureau or high-volume extraction workflow for unauthorized users.
We may monitor aggregate usage, login patterns, device and session patterns, IP and location signals, download and export volume, processing jobs and other security or usage signals to enforce these Terms, protect the Service and control costs. We may warn, throttle, require a plan upgrade, limit features, revoke trials or promotions, suspend access or terminate accounts where usage is abusive, fraudulent, excessive, automated, security-sensitive, or inconsistent with the plan's intended scope.
For teams, agencies or studios that need multiple people to use the Service, each person needs their own authorized account or an agreed team or studio arrangement.
Intended Use
Hold my Frame is a professional visual reference and research platform. You may use the Service to:
- Search and browse film stills for creative reference.
- Create moodboards, pitch boards, saved searches and project collections.
- Organize and share references within your team or project context, where the Service provides that functionality.
- Upload and process content that you are allowed to use for your own research or project workflow.
Restrictions
You may not:
- Redistribute, resell, sublicense, publish, or make available any content from the platform outside the intended reference workflow.
- Use automated tools, scraping, crawling, spidering, bulk downloading, credential sharing, or other extraction methods.
- Copy, store, export, or reconstruct a substantial part of the Service, database, metadata, embeddings, search results, or media library.
- Use the Service or its content to build, train, fine-tune, benchmark, validate, evaluate or improve any AI model, machine-learning system, computer-vision system, dataset, search engine, media database or competing product without our prior written permission.
- Use media, metadata, embeddings, captions, search outputs, similarity scores, look-match results or other Service output for dataset creation, model training, model evaluation, reverse engineering or automated content extraction.
- Bypass authentication, access controls, rate limits, media protection, download limits, or security features.
- Probe, scan, stress-test, reverse engineer, decompile, or attempt to discover source code, infrastructure, private API behavior or non-public data.
- Upload or submit material that infringes third-party rights, violates privacy or publicity rights, contains malware, or is unlawful, harmful, abusive, deceptive or otherwise objectionable.
- Use the Service for any unlawful purpose.
A violation of these restrictions may result in suspension, termination, removal of content, loss of access, and any other remedies available under applicable law.
Platform Content and Intellectual Property
The Service, including its software, interface, search technology, metadata, visual organization, generated previews, descriptions, classifications and databases, is owned by or licensed to Hold my Frame and is protected by copyright, database, trademark and other laws.
Film stills, previews and other visual content shown through the Service may be sourced from publicly available advertising films, uploads, or third-party materials and are provided strictly as professional reference material. Hold my Frame does not claim ownership of third-party films, brands, trademarks, music, footage, logos or underlying works. All rights remain with their respective owners.
Unless a separate written license says otherwise, your access to platform content is limited to internal reference, research, pitch and educational use inside the Service. The Service does not grant you clearance to publish, reproduce, commercialize, distribute, modify, train on, or otherwise exploit any third-party content. You are responsible for obtaining any permissions, licenses, talent releases, music rights, trademark clearances or other rights required for your own productions, client work or public output.
Your Content and Uploads
You keep ownership of content, briefs, prompts, projects, tags, saved searches, uploads and other material you submit to the Service ("User Content"). You confirm that you have the rights necessary to submit and process that User Content and that doing so does not violate any third-party rights or laws.
You grant Hold my Frame a non-exclusive, worldwide license to host, store, process, transcode, analyze, display and transmit User Content solely as needed to operate, secure, support and improve the Service for you and any users with whom you intentionally share it. This license ends when the User Content is deleted from active systems, except where retention is required for backups, legal obligations, security, billing, audit logs, or legitimate dispute handling as described in our Privacy Policy.
We may remove or disable User Content if we believe it violates these Terms, third-party rights, law, security rules, or reasonable quality and safety standards.
Copyright and Takedown Requests
If you believe content available through the Service infringes your rights, contact us at [email protected] with enough information to identify the content, your rights, and the requested action. We may remove, disable, restrict, or investigate content at our discretion and may terminate accounts of repeat infringers.

Third-Party Services
The Service relies on third-party providers such as Cloudflare, Stripe, Resend, Google and Modal, and may contain links to external websites or services. We are not responsible for third-party services, websites, content, terms, errors, outages or data practices. Your use of third-party services may be governed by their own terms and policies.
Paid Plans, Trials and Billing
Some features may require a paid subscription or paid plan. Prices, plan limits, included features, usage limits, search limits, upload limits, download limits, processing limits and billing periods are shown at checkout or inside the Service. Payment processing is handled by Stripe. We do not store full payment card details.
Subscriptions may renew automatically unless cancelled before the end of the current billing period. You can manage or cancel paid plans through the billing portal in account settings where available. Unless required by applicable law or expressly stated otherwise, fees already paid are non-refundable and cancelling a subscription does not shorten access already paid for during the current billing period.
Trials, discounts, referral rewards or promotional offers may be changed, withdrawn or revoked if abused or used contrary to their stated conditions.
Beta, preview and experimental features
We may offer beta, preview, experimental, invite-only or early-access features. These features may be incomplete, unstable, inaccurate, rate-limited, changed, suspended or discontinued at any time. Beta features are provided for testing and feedback and may not be available to all users or plans.
Unless we expressly state otherwise, beta and preview features are subject to these Terms, including the same content restrictions, account rules, privacy rules, liability limits and usage limits that apply to the rest of the Service.
Refunds and Withdrawal
Refunds, cancellation and statutory withdrawal rights are described in our Refunds & Withdrawal policy. If you are a consumer in the European Union, you may have a 14-day withdrawal right unless an exception for immediately supplied digital services or digital content applies under mandatory law.
Service Changes and Availability
We may improve, change, suspend, restrict or discontinue parts of the Service at any time. We aim to keep the Service reliable, but we do not guarantee uninterrupted availability, permanent storage of every item, or error-free operation. We may impose limits on usage, storage, processing, API access, media delivery, downloads, accounts or features where needed for security, performance, cost control or product reasons.
Account Suspension and Termination
You may stop using the Service at any time and may request account deletion through settings where available. Active paid subscriptions must be cancelled before account deletion if the system requires it.
We may suspend or terminate access, remove content, or restrict features without prior notice if we reasonably believe that you violated these Terms, created security or operational risk, infringed rights, failed to pay fees, abused trials or referrals, or used the Service in a way that harms the platform, other users, third parties, or us.
Terms that by their nature should survive termination will continue to apply, including restrictions on content use, payment obligations, intellectual property provisions, disclaimers, liability limits, indemnity, governing law and dispute provisions.
Disclaimers
The Service and all content are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability and uninterrupted operation.
Search results, tags, generated descriptions, visual analysis, pitch suggestions, metadata, profile information and similarity results are provided as assistive tools and may be incomplete, inaccurate or subjective. You remain responsible for reviewing outputs and for any creative, legal, commercial or production decisions made using the Service.
Limitation of Liability
To the fullest extent permitted by applicable law, Hold my Frame will not be liable for indirect, incidental, consequential, special, punitive or exemplary damages, including lost profits, loss of business, loss of goodwill, data loss, production delay, content clearance issues, service interruptions, unauthorized third-party conduct, or reliance on inaccurate results.
Where liability cannot be excluded under mandatory law, our total liability for claims relating to the Service is limited to the amount you paid to Hold my Frame for the Service in the twelve months before the event giving rise to the claim, unless mandatory law requires otherwise.
Indemnity
To the extent permitted by law, you agree to indemnify and hold Hold my Frame harmless from claims, damages, losses, liabilities, costs and expenses arising from your use of the Service, your User Content, your violation of these Terms, your infringement of third-party rights, or activity carried out through your account.
Assignment
You may not assign or transfer your account, rights or obligations under these Terms without our prior written consent. We may assign or transfer these Terms in connection with a merger, acquisition, restructuring, sale of assets, or transfer of the Service.
Force majeure
We will not be responsible for delays, failures, interruptions or non-performance caused by events beyond our reasonable control, including outages or failures of hosting providers, cloud services, payment processors, network infrastructure, third-party APIs, power supply, telecommunications, labor disputes, legal restrictions, security incidents, natural disasters, war, civil unrest, epidemics, or other force majeure events.
Notices
We may send notices through the Service, by email to the address associated with your account, or by posting an update on the relevant legal page. You are responsible for keeping your account email current. Legal notices to Hold my Frame should be sent to [email protected].
Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated date. For material changes affecting registered users, we will use reasonable efforts to notify you by email or inside the Service. Continued use after changes become effective means you accept the updated Terms.
Language and order of documents
These Terms are written in English. If they are translated, the English version controls unless mandatory law requires otherwise. If these Terms conflict with another policy referenced here, these Terms control unless the other policy expressly says that it overrides a specific provision.
Governing Law & Jurisdiction
These Terms are governed by Austrian law, excluding conflict-of-law rules. The courts of Vienna, Austria have exclusive jurisdiction, unless mandatory consumer protection law provides otherwise.
The European Online Dispute Resolution (ODR) platform was discontinued on July 20, 2025. Current EU consumer redress information is available at consumer-redress.ec.europa.eu. We are not obligated or willing to participate in dispute resolution proceedings before a consumer arbitration board unless mandatory law requires otherwise.
